1. Acceptance of Terms
- By creating an account and using PeaSoup Object Storage (the “Service”), you agree to these Terms and Conditions. If you do not agree, please do not use the Service.
- If you are using the Services on behalf of an organisation, then you are agreeing to these Terms of Use for that organisation and confirm that you have the authority to bind that organisation to these Terms and Conditions. In that case, “you” and “your” will refer to that organisation.
2. Modifications to Terms
PeaSoup reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website, and your continued use of the Service constitutes acceptance of the updated terms.
3. Account Registration
To use the Service, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your credentials and for notifying PeaSoup of any unauthorised access to your account.
4. Scope of Service and Usage
4.1 Permitted Use: PeaSoup Object Storage is intended for standard data storage, retrieval, and backup. Usage beyond standard practices, such as frequent automated requests, may be considered excessive and subject to review under our Fair Use Policy.
4.2 Free Egress Limit: PeaSoup includes a monthly free egress limit equal to the total size of your stored data. Exceeding this limit may result in additional charges as per our Fair Use Policy.
4.2 Use of and Changes to the Services:
- You may use the Services only if you have the power to form a contract with PeaSoup and are not barred under any applicable laws from doing so.
- The Services may continue to change over time as we refine and add more features, and we may modify any content from the Services from time to time.
- In the event of a service change, as set out in clause 4.2(b), we will provide at least 30-days’ notice prior to taking such action, save where the changes to the Services are the result of (i) minor technical adjustments, which can be of no real significance; (ii) changes required by law; (iii) changes required by necessity (e.g., to ensure the integrity or security of the Services or your data), or (iv) enhancements to the Services to reflect advancements in technology for your benefit.
- During the term of this Agreement, an increase in prices could be applicable. We provide you with a minimum 30-day prior notice.
- If you do not agree to the service changes made to the Services described in Section 4.2, you may terminate your use of the Services within 30 days of receiving the notice.
4.3 Prohibited Actions: You agree not to:
- Access the Service through unauthorised means.
- Engage in activities that harm or disrupt the Service, including data scraping or storing illegal content.
5. Data Security and GDPR Compliance
PeaSoup takes reasonable measures to secure data stored within our system in compliance with the General Data Protection Regulation (GDPR) and applicable UK data protection laws.
- User Responsibility for Data Backups: PeaSoup does not provide guaranteed data backup or recovery. Users are responsible for their own data backups.
- Data Processing and Rights: PeaSoup will process user data solely to provide storage services and in compliance with GDPR. Users may request data access, correction, or deletion by contacting PeaSoup Support.
6. Customer Support
6.1 System Outages: In the event of a system outage, PeaSoup provides 24/7 monitoring and updates on https://status.peasoup.cloud/. Customers can subscribe for real-time updates and planned maintenance notifications.
6.2 Customer Support Requests: For non-outage issues, support is available through our ticketing system during business hours (Monday to Friday, 9:00 AM – 5:00 PM, UK Time Zone, excluding public holidays). Support is limited to issues related to PeaSoup S3-Compatible Object Storage and does not cover third-party integrations.
7. Legal Disclaimer
PeaSoup Object Storage is provided on an “as-is” and “as-available” basis, and PeaSoup makes no warranties regarding uninterrupted access, security, or suitability for specific purposes, except as required by law. For further details on liability limitations, service disclaimers, and customer responsibilities, please refer to the full Legal Disclaimer Policy.
The Legal Disclaimer Policy is an integral part of these Terms and Conditions, and by using PeaSoup Object Storage, you agree to the terms outlined in both the Terms and Conditions and the Legal Disclaimer Policy.
8. Fair Use Policy
PeaSoup includes a Fair Use Policy to maintain service quality. Activities causing excessive load on our resources, such as high-frequency requests or bandwidth consumption beyond the monthly free egress limit, may result in additional charges, restricted access, or suspension.
9. Changes to the Terms and Disclaimer
PeaSoup may update these Terms and the Legal Disclaimer to reflect changes in our services, legal requirements, or industry standards. Any updates will be posted on our website, and continued use of PeaSoup Object Storage constitutes acceptance of the revised Terms and Disclaimer.
10. Service Level Agreement (SLA)
PeaSoup is committed to providing high-quality, reliable service. Our Service Level Agreement (SLA) outlines our commitments to service uptime, support response times, and compensation in the event of service level breaches. The SLA is an integral part of these Terms and Conditions, and by using PeaSoup Object Storage, you agree to the terms set forth in the SLA.
11. Copyright Policy
11.1 Ownership of Content
All content, software, text, images, graphics, and other materials available on PeaSoup Object Storage and associated websites (collectively, the “Content”) are the intellectual property of Pea Soup Hosting Limited. and are protected by copyright, trademark, and other applicable laws. PeaSoup retains all rights, title, and interest in and to the Content and the Service.
11.2 Limited License
PeaSoup grants customers a limited, non-exclusive, non-transferable license to access and use the Service solely for lawful business or personal purposes in accordance with these Terms and Conditions. This license does not grant any rights to:
- Modify, copy, reproduce, or distribute the Content without express written permission from PeaSoup.
- Reverse-engineer, decompile, or create derivative works from any part of the Service.
- Use any PeaSoup trademarks, logos, or branding without prior written consent.
11.3 Customer Content
PeaSoup makes no claim of ownership over any data, files, or content that customers store on the Service (“Customer Content”). By using the Service, customers grant PeaSoup a limited licence to host, process, and transmit Customer Content as necessary to provide the Service. PeaSoup respects all intellectual property rights in Customer Content and expects customers to use the Service in compliance with applicable copyright and intellectual property laws.
11.4 Reporting Copyright Infringements
PeaSoup respects the intellectual property rights of others and expects our customers to do the same. If you believe that any content on the Service infringes your copyright or other intellectual property rights, please contact us at administration@peasoup.cloud. Upon receipt of a valid infringement notice, PeaSoup will review and address the complaint in accordance with applicable copyright laws.
